Terms of Service

These Terms of Service ("Terms") govern your access to and use of the JaldiDM website and platform (the "Service") operated by JaldiDM ("JaldiDM", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

JaldiDM is a software platform that lets businesses send and receive messages, run broadcasts and chatbots, and manage customer conversations over the official WhatsApp Business Platform (Cloud API) provided by Meta. JaldiDM is an independent technology provider and is not endorsed by or affiliated with Meta beyond its participation in Meta's developer programs.

2. Eligibility & accounts

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for all activity under your account and your team members' accounts.

3. Acceptable use & platform compliance

When using the Service you agree to comply with all applicable laws and with Meta's policies, including the WhatsApp Business Messaging Policy, WhatsApp Commerce Policy, and the Meta Platform Terms. You must not:

• Send spam, unsolicited, deceptive, or unlawful messages, or message users without a valid legal basis or opt-in where required.
• Distribute malware, phishing, or content that is illegal, hateful, or infringing.
• Attempt to reverse engineer, disrupt, or gain unauthorized access to the Service.
• Use the Service to violate the rights or privacy of any person.

You are solely responsible for the content of the messages you send and for obtaining any necessary consent from your recipients.

4. Fees & Meta charges

Paid plans are billed as described on our Pricing page. Our subscription fee covers the JaldiDM software only. Meta's official WhatsApp conversation charges (Marketing, Utility, Authentication, and Service categories) are billed separately by Meta directly to your own Meta/WhatsApp Business account, at Meta's country-specific rates. Fees are non-refundable except where required by law.

5. Your data

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your business data and message content. You grant JaldiDM a limited license to process that data solely to provide the Service.

6. Intellectual property

The Service, including its software, design, and trademarks, is owned by JaldiDM and protected by law. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service.

7. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, violate Meta's policies, or create risk or legal exposure for us. Upon termination, your right to use the Service ends and we may delete your data as described in the Privacy Policy.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that message delivery (which depends on Meta and the recipient) will always succeed.

9. Limitation of liability

To the maximum extent permitted by law, JaldiDM will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the claim.

10. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Courts located in India will have exclusive jurisdiction, unless applicable law requires otherwise.
